By default, Tracker offers phased litigation and phased patent budgets. Tracker also offers Tracker Coordinators and Company system administrators the ability to create custom phased budgets. The budget edit form requires user to enter all phases of a budget -- i.e., the total budget for the entire litigation or patent process. Below is a list of the phases and a description of the activities in each phase for a litigation budget:
Initial Case Assessment and Handling: can include fact investigation, case evaluation, initial pleadings/motions, settlement
Discovery and Post Discovery Motions: can include written discovery, document production, depositions, expert discovery, discovery motions, dispositive motions, settlement/ADR
Trial Preparation: can include preparation of fact witnesses and expert witnesses, trial motions and submissions, settlement/ADR
Trial and Post-Trial Motions
Appeal
Below is a list of the phases and the description of the activities in each phase for a patent budget:
Preparation: can include review of the disclosure, interview with inventors, preparation of application and filing papers, drafting of formal drawings, drafting of claims, etc. Includes filing expenses. Waiting Period for Office Actions: Filing an IDS, Replying to Notice of Missing Parts, Filing Assignments, etc. Prosecution: Replying to one or more Office Actions, drafting claim related files, Examiner interviews, answering restriction requirements, Appeal before BPAI, etc. Post Allowance: Reviewing allowed claims for continuation determination, file wrapper clean-up, reviewing issued patent, filing request for Certificate of Correction, ordering copies of patent, citations of prior art, etc.
Maintenance & Annuities: Payment of annuity amounts
These phases structured chronologically (i.e., each phase is identified through a designated month). The number of phases, and the description of the activities in each phase, cannot be modified.
Tracker also offers company system and Tracker system administrators to create new custom phased budget types. These users can do so in Settings > Phased Budget Type.
